Total to charge
R$ 1.540,00
- Days late
- 20
- Late fee
- R$ 30,00
- Interest
- R$ 10,00
Late fee applied once to the original amount; simple interest proportional to the days late (30-day month).
How the calculation works
The late fee is applied once to the original amount, from the first day of delay. Interest is simple and proportional to calendar days, based on a 30-day month.
Example: R$ 1.000,00 with a 2% late fee and 1% monthly interest, paid 15 days after the due date, becomes R$ 1.000,00 + R$ 20,00 + R$ 5,00 = R$ 1.025,00.
Frequently asked questions
What is the maximum late fee?
In consumer relationships, the Consumer Protection Code (CDC) caps the late fee at 2% (art. 52, § 1). Between businesses, the contract applies, within the penalty clause limit of the Civil Code (art. 412).
What if the contract says nothing about interest?
The legal rate under art. 406 of the Civil Code applies, which since Lei 14.905/2024 equals the Selic rate minus the IPCA.
Is monetary correction included in the calculation?
This calculator shows the late fee and interest. For long delays, add the correction by the contract index or, if there is none, by the IPCA.
