Court-awarded fees are set by the judge between 10% and 20% (CPC art. 85, § 2), paid by the losing party, and belong to the lawyer (Lei 8.906/94, art. 23).
How the calculation works
Contractual fees add up the fixed portion (which may be paid in installments), the success fee on the economic benefit and the hours, if any. Court-awarded fees (sucumbência) are calculated separately: they are set by the judge and paid by the losing party.
Use the amount in dispute or the expected economic benefit as the base. The result helps you put together the proposal and the fee agreement.
